Visa pending and course is about to finish

Hi all,

Wonder if anyone can advice.

My brother applied for T4 (general) on MBA course before his PSW visa expired around 8-9 months ago. His documents are still pending with UKBA, when queried they confirmed it and promised asap decision.

However, his MBA will soon finish and he wants to apply for PhD.

If visa for MBA is not issued by the time he has completed it and needs to apply for PhD:

- Does he need to submit new Tier 4 application?
- If yes, does he needs to show £9k (London) maintenance requirement, since his latest issued visa was PSW, even though he has been doing MBA on pending application for the last year?
- Is there any legal requirement to force UKBA to make decision before MBA is finished?

You can vary the ground of your application since your brothers circumstances have changed, however he needs to provide fresh docs for his new course, new cas number, maintenance funds etc

Basically it will be like making a fresh application but he would save on the application fee.
