ILR...

Post by ayshe » Fri Nov 09, 2012 2:40 pm

Hello all , Could anyone please give me advise or any help at all please ....

I am British,my husband is Turkish , he has a 2 years spouse visa which is due to expire in 3-4 weeks time,
We have booked an app. in Croydon after 2 weeks.
He currently works full time , i dont work , we have a child 1 years old.
We are living in a council temporary accodommation.

These are the benefits we are receiving;

CB - in my name
CTB-in both of our names
Working TC- in my husbands names , but all these are going in to my bank account.
HB- joint name
Council tax - joint name
On the Set M Form, we are totally confused of which boxes we need to tick ,
Wich are under recourse public funds,and wich are not
Do we tick both of us column or only me . Totally stuck :(

We are concerned of all the benefits we are getting , would all of this affect him getting is indefinite ..

These questions have been asked and answered many times before on this board.

As regards :-
CTB-in both of our names
Working TC- in my husbands names
-: Tax Credits, of both varieties, are claimed jointly by a couple living together. It is totally impossible for the Child Tax Credits to be in joint names, and the Working Tax Credit to be in your husband's sole name.

As regards how to complete the badly designed form SET(M), as before the comment is that the relevant benefits are not ticked in the applicant's column, but are ticked in the partner's column.

thanks for the reply ;
i am so sorry i was ment to mention child tax credit is in my name and as you stated working tax credit as a joint thats right, so when ticking the benefits boxes , only i am going to state myself and not my partner is that correct right ? . does he need to tick any boxes and still i couldnt find the answer for would these affect his application. many thanks ..

i was ment to mention child tax credit is in my name and as you stated working tax credit as a joint
Still not quite right, there is just one claim form and both types of Tax Credits are being claimed in joint names.

The problem is that the form SET(M) is badly designed and for technical reasons the benefits being claimed by your husband are not Public Funds, thus it is logical that he would not put any ticks in his column.

Based upon what you have posted, the accommodation will not be a problem.

Proceed to apply.
