If you are in the UK now, what is your current immigration status?

My guess .... Tier 1 (PSW).

As a PSW migrant your position doesn't have to undergo the RLMT but you do have to be sponsored. You said your employer was not registered and clearly that is a problem.

For you to switch to Tier 2 General a RLMT is not required but the company must have a T2G sponsor licence. To get one is a long process (currently 6-8 months) and you would need to find out if your current employer is willing to do it. Even if they do your leave may expire before they get the sponsor licence in which case you ought to look for another job with a company who do have a licence.
