Benefit help

Our baby was born 3 weeks ago my partner is an overstayer from Brazil(which i am trying to find a solution to fix) and i am the father British.

We havnt registerd our son yet but when i do will i be able to claim any benifts? child benifit, child tax credits etc? will i be entitled to do so.

Any help on this matter would be greatly appreciated.

It also now looks like i am going to loose my job at christmas, will i be able to get HB+CTB with my partners situation like it is?
Will it be me who has to be the main claimant for child benifit etc because i am the British citizen(farther)?.

Thank you for the reply sushdmehta but i notice the info is regarding indefinite leave to remain does all this apply too me as my partner currently has no status in the uk (overstayer).

But my child has been registered in my name as well as i am he father so that that makes him a British citizen should i really just be claiming for my self and my child and notifying the relevant bodies my partner is with me but with no income or recourse to claim benefits?.

I also have a quick question regarding child benefit i understand i am eligible to claim this myself but not my partner does that mean

1.i have to put myself as the main claimant on the form and then it just asks for my partners nationality or

2.do i just leave my partner off the form all together?

I assume its 1. but please anybody correct me if im wrong.

Ok i will try again with my questions as i am trying to seek some kind of clarification on these things.
Can anybody please help me i need some advice I am British and my girlfriend is Brazilian we have just recently had a child together my child is British.

My girlfriend is an over stayer and we have an appointment in January to seek advice on how to alter this situation the problem is my job is going to be ending in December and i am going to have to claim some benefits job seekers, HB+CTB could anybody advise me on the best way to approach this?.

The questions i have is
1.Do i claim job seekers for just me and my child but inform DWP that my partner is there?
2.With HB and CTB do i make the claim in my name for me and my child and just notify the council that my partner is living with me and hasn't any permission to work and no income?.

Any help would be much appreciated.

if you are british then you can claim CB and/or other benefits , cannot see any issue with your partner being an overstayer.

Just one more thing when i notify the DWP and Council will they report her to Immigration? will they come and arrest her?

Now you have a child you should really sort out your partners situation.
May I suggest you seek legal advice and help in this matter.

I can see your partner would have a reasonable chance to be allowed to remain in the Uk.

You could visit your local CAB to start with and see where this may lead.
