Dear All,

I will qualify to apply for ILR -under the 10 years route- in Januray 2014. I have not yet spent 540 days (18 months) out of UK, and I haven't also spent more than 6 months in one go.

But I will be required to travel back-home for at least 5 months commencing on January 2013. I am currently on PSW visa, which is valid until March 2014. However, I currently do not work or study.

I would be utterly grateful if you could, please, answer the following:

1. Would I be allowed entry (to the UK) as at the time of my return I would only have 6/7 months left for ILR eligibility. I have heard (not sure though) that people are randomly refused entry when they are on PSW but not doing anything significant in the UK, and specially when people are near the end of their 10 years route.

2. If I am allowed to enter, Do i need to explain to the UKBA (when I apply for ILR under the 10 years route) about my 5 months' absence from the UK? Does it matter as long as it's not over 6 months?

Your help would be greatly appreciated.

1. As you said, you could be one of those 'random' refusals.

I was under the impression that you could not spend more than 90 days out of the country in one go. I was also under the impression that it was considered continuous stay if there is not more than a 6 month gap between visas (ie, leave the country and be granted a new visa within 6 months of expiry of the old one). I am also looking to qualify under this route, and spent 97 days out of the country in one go in 2007. I thought this was going to be a problem!!
