Help Needed for ILR Application With My Special Case THANK U

Post by cvv09 » Sat Nov 10, 2012 11:56 pm

Greetings,

I am posting here to seek your kind advice & help on my special case in ILR application, my details are as follows:

2007-11-21 Received HSMP Visa for 2 years, valid till 2009-11-21
2007-12-29 Entered UK
2009-11- 29 Received Tier 1 Extension Visa for 3 years, valid till 2012-11-29

However in early May 2010, my mother who was visiting me at the time had a stroke and when I sent her back home, she had a life threatening cerebral haemorrhage.
As medical cost and care was very expensive in my home country, I travelled to relatives in other provinces to borrow money --- In late May 2010, I had a traffic accident in one of the trips (driver ran away), which gave me closed chest injury, large area of hematoma and concussion. Because mother needed money and I was previously in uk for 5 years with no insurance in home country (so medical treatment was unthinkably expensive), I was in bed for 3 weeks receiving no treatment.

2011-11-18 I came back to UK after 18 months, before that:
my mother was in life threatening illness she could die in any minute because of cerebral haemorrhage and further she had problems with her kidney (which shrank 5/6 to 1/6 of normal size, removal and replant surgery is needed but not affordable now), and rheumatism that changed the shape of her fingers.
As an only child I had spent all my money and borrowed money from where possible and looked after her day and night. While myself had health problems and financial difficulty coming back until my friends eventually bought me a flight ticket and lent me some money to start living in uk.

But after I came back in November 2011, I have been unable to find a job in my profession, because my visa was expiring very shortly. So I only sell little things on ebay and do some translation to make a living. Now I also have a tumour/lump in my left hip and high blood pressure as a result of the accident, and am in psychological treatment too (because I am female and single, there has been tremendous pressure from family on marriage to pay off debts, I have found myself unable to sleep at night for months.)

================================================================================

My question is :
Can I apply for PR with regards to eligibility (absence, lack of employment) and timeline (am I having 2 days short of 5 year requirement)?

Ps my experience before 2010 was roughly as follows:

Post by cvv09 » Sun Nov 11, 2012 12:03 am

2003-2006 Studying in UK in a top university
2007-2009 During first 2 years of HSMP, I worked as a professional for reputable employers in industry.

Except for the time (2006-2007) after my graduation and before I applied for HSMP and worked in my home country, I did not leave UK even for 1 day during my 5 years stay.

If you do not score the required points that you need, you cannot apply for extension or settlement as a Tier 1 (General) migrant.
