do these new rules apply to my spouse

I am british citizen since one year, before that i was on 4 years work permit on and my wife came to uk as my dependent stayed here about 2 months and went back home although she had 4 year dependent visa after about 2 years i changed my job and i got another 5 years work permit with other employer and my wife came back before i applied and she got 5 years dependent visa again as she applied same time with me. She stayed here for about 2 years and she had to go back to back home and since then she never come back. i have a 4 years old son who just got register as british citizen recently as i applied for him on MN1 form under sec 1(3) because he was born here in uk and went back with his mother 4 years ago.
I got my ilr and bc after she had gone to back home
Now my question is does my wife come under new spouse visa rules or old rules.
Could any body answer please please.

If she has no current visa with which to enter the UK and wants to apply for entry clearance, she will fall under the new rules for partner settlement applications.
