Tier 2 - PSW to Tier 2 General (Urgent!)

Hi All..

My current PSW visa expires on 3rd Dec 2012. I am currently working with a company more for than 1 yr 3 months. They are willing to sponsor me and so applied for a sponsors license on 20th Sep, and the decision from ukba is still awaited. My HR inquired ukba for status of the application as my visa is expiring soon, and they replied that they can only make the application treated as "urgent" only if asked before 10 days of my visa expiry.

By browsing through some of the threads here makes it obvious that there are many cases like me.

Can anyone advise me on the below:

1) Is it possible for me to leave to my country by 3rd Dec and apply from there as "Outside UK Application for Tier 2" with the same COS (if my company gets one after my current visa expiry?)

2) I came to know reading some of the posts here, that a 28 day overstay is legal. But one of my friend advised that even 1 day overstay will be stamped on my Passport and will jeopardize my applications to any other countries in future including UK. Is this true?

3) What is the best course of action for me if my company fails to get sponsors licence before my current leave expires?

An application from outside the UK will have to undergo the resident labour market test.
