extending Tier1 visa

Post by tushartandon » Tue Nov 13, 2012 5:37 pm

Hi,

I am extending my tier-1 visa next month. When i applied for visa in Feb 2011, investment bank paid me 10K bonus in Dec, 2010. But I left the bank in March 2011 and i had to pay bonus back. Bonus helped me to cross the salary limit. Since, I did not pay tax for that 10K as the firm took money back. Can UKBA reject my extension on the basis of ground that 10K was used as a salary points and I did not pay tax.

Does UKBA check the earnings statement or documents that you gave when you first applied for visa when you extend visa ???

It's not possible to claim points for unconfirmed income so you clearly (knowingly or unknowingly) misrepresented that payment as confirmed income. You should have paid tax on the sum if it was a genuine bonus payment. The UKBA has measures in place to prevent temporary loans being disguised as income.

I think you would need to elaborate what actually happened to get any meaningful advice.
