section D and opening your business with a partner-director?

Post by sky_rise » Wed Nov 14, 2012 1:59 am

hi All,

I am interested to find out whether it is under the rules.

Say, I will now form a new company together with the person who is in the country under the Entrepreneur visa (already got with 200k rule). Note that it is not a joint application, we just form a partnership for business, but not visa.

We can surely become equal owners of the business and co-founders, but can we also be both co-directors ( i mean, EQUAL directors) and that then I can apply within 3 months with that company?
Surely a company may have as many directors as it wishes.

Also I assume another person has nothing to do with me applying, i.e. I apply by myself without him.

So here, I fulfil the rule to form a company (with partner), to become a director of it (one of the two), i have access to money and maintenance, also contracts and proof of marketing etc.

Thank you, it is important to understand whether it makes difference for applying under D) route if you form a company by yourself or with someone who is already an entrepreneur.

I don't see a problem with that scenario. Thiswould not be classified as an entrepreneurial team so obviously you will have to put your 50K into the business and he will have to put his 200K into the business.

oh yes absolutely. that said, we can register more than one business, and invest the moneys into others as well.

The other point being here - they do not mention in regulations, which director you have to be - general or some other.

is it true that there is a rule for secction D applications, that we must hold the control in the business that we establish (alone or with partner), i.e. at least 50.01% of the company, AND also be a director. Or you cna have it as 50/50 ownership + 2 directors. ?
