Information needed on ILR pls

Hi,

I entered the UK on 28th October 2008 on a business visa and stayed for 2 months and went back to India to get get my work permit done and came back within 3 weeks on 6th Jan 2009. My wife joined me in the UK as dependent on my work permit visa and got a job in a UK company.

My work permit was later converted (on extension) to Tier 2 ICT long term (established staff).

Now my wife's company has agreed to process her Tier 2 general visa for 3 years but she has to get that done in India. And my contract is expiring on the 4th January 2013 which means I my tier 2 ICT visa will not be extended.

I will have completed 4 years in UK and am planning to become a dependent on my wife's tier 2 general visa after the 4th of January 2013.

My question really is, will I be eligible to apply for ILR after I complete 5 years of stay in the UK? Please note that I have not been away from UK for more than 30 days in my entire stay over the past 4 years.

Also will my wife be eligible to apply for ILR as she will also complete 5 years of stay in the UK on 6th Jan 2014?
