PBS Tier 2 Dependent

Post by Bijoux24 » Thu Nov 15, 2012 12:11 am

Hello
I have a query about the current changes in the family route
I am currently on Tier 2 visa expiring Dec 2014, I am due to apply for ILR in July 2014. My husband is applying to join me in January 2013 as a PBS dependant.
What happens when I apply for my ILR in July 2014? Does he have to wait till I get my docs back then apply as a spouse of a settled person? And if so will that mean he will be put under the5 yr partner rule and will not be eligible to apply for ILR till 5 yrs time?

Thanks in advance

The qualifying residential period for settlement for dependants under PBS or family route is now 5 years.

When your husband will apply for entry clearance in January 2013, he will be subject to the 5 year probationary period. PBS dependant can now keep on extending their stay in the UK as a PBS dependant (even when the migrant he / she is dependant on goes on to become a settled person or British citizen thereafter) until he/she becomes eligible for settlement.
Life isn't fair, but you can be!

Thanks for the reply.
So basically he will have to wait till I (fingers crossed) get my ILR then apply as my dependant till he completes the 5 years.
