Advise please regarding spouse English requirement

Post by ahmed2020 » Thu Nov 15, 2012 1:57 am

Hello everyone,

My wife submitted a settlement spouse application from outside the UK on the 25th of August and we are still waiting. She is a doctor and studied Medicine in English. On her application, we submitted her bachelor degree certificate and a formal letter from the university confirming that the course was taught in English.

We didn't know about the PBS calculator at the time and we simply followed the simple instructions on the UKBA website. I have now found out that my wife's qualification does not meet the English language requirement on the PBS calculator.

The PBS calculator on UKBA website seems to be for Tier 1-4 visas which I would have thought require higher English level requirement. Do they also use it to assess the english requirement for dependent spouse visas?

If you think that my wife's application is likely to be refused on the language requirement basis, should she do an english exam as soon as possible and then submit the English certificate with her appeal if they refuse her current application?

Grateful for any advice.

She will have to apply again.

Many thanks for your reply.

It is frustrating. The UKBA did not mention anything about NARIC on their required documents page for spouse visa.

http://www.ukba.homeoffice.gov.uk/visas ... -language/

How difficult is it to point out that a statement of comparability is required from NARIC.

Can someone please clarify the PBS calculator:

I just rechecked my wife's degree on the PBS calculator. The calculator gives 30 points for qualifications but 0 points for English skills.

Does that mean that her degree is comparable to a UK degree, hence we don't need a statement of comparability from NARIC???
