When I can apply for Visa under Tier 2 ICT

When I can apply for Visa under Tier 2 ICT

Hi There

Please help in 1 query..

I got UK Tier 2 ICT visa in Dec 2010 and went to UK in Jan 2011 and came back to India on 31st Dec 2011...This visa was originally till Jan 2013..

Then I changed my employer/sponsor in Apr 2012.

Please let me know when I would be able to apply for Tier2 (General) or Tier 2 (ICT) with my new employer..

I am not sure when my previous employer intimated UKBA about my resignation but in Jul 2012, I applied UK Business Visa with my new sponsor and got it for 6 months...

Please help me in this as I am not getting any reply from anywhere...

You are at present outside the UK and started a job in April 2012 (not sure why you use the word "sponsor").

To come to the UK as a T2 ICT migrant you will need to have worked for your present employer for at least 12 months and they would need to have an establishment in the UK. So, provided you have a CoS, April 2013 is the earliest. The cooling-off period doesn't apply to you if your application is in the T2 ICT Long Term Staff category.

In the T2 General category the 12 month cooling-off period would apply and this is counted from the end of your previous leave as a T2 migrant. You need to find out if your previous employer reported to UKBA that you left them and whether your visa was curtailed accordingly (UKBA would normally have written to your UK address). In case of difficulty about finding out this information you can submit a Subject Access Request (SAR) to UKBA which will show your immigration record.

This date will be about 3 months after the date of reporting. (btw - your previous employer should have reported that you left them within 10 days of your employment finishing!)

Also could you please suggest for ICT Long term, is there any difference in pay which my present employer needs to show..Your pay incl. allowances needs to be at least £40k or the minimum prescribed by the job SOC code if that is higher.

My company has establishment in UK. you must have worked for them for at least 12 months before you are eligible for T2 ICT
