Lost passport with ILR - PLEASE HELP

Hi,

Need some help

Spouse has lost her passport with ILR on there.. but have got a question to see if i can apply for citizenship without having to apply for NTL

Facts:

Mrs came to country in Sept '09
ILR granted April '12
She has been in this country for 3yrs so im guessing i can apply for citizenship

If i get a Subjects Access Request from UKBA along with new passport and police report of lost passport and documents that i used for ILR to confirm residence?????

Is this sufficient enough?

I presume you are British.

Does she have the ILR approval letter? This can be used instead.

Hi,

Yes i am British... i do have the ILR approval letter but would need to replace the Pakistani passport....

So i'm good to go

SO to confirm i send:
NEW pakistani passport WITHOUT ILR STAMP
Police Letter to confirm lost passport
ILR Approval Letter

Hi

I'm also in a similar situation with both me and my wife missing our passports with the ILR stamping on it.

I dont have the letter from UKBA but have the copies of the ILR stamping on the passport. Did you manage to find some more information as to if we can apply for the naturalisation with a passport without the stamping.

Hi

I have spoken to a solicitor who advised that as long as i have a passport, the Home Office Letter with ILR confirmation (i.e. via Subject Access Request) and police report of lost passport then it is good to send for Citizenship.

I spoke to sunrise solicitors (on google)

I am going to go again to another solictors on Monday to get confirmation before sending anything.

Hi Vinny

Thanks for pointing it out and have applied for SAR.

I noticed that the home office is asking for passports as evidence of stay. I believe they are going to check the stamps on the passport.

With the new passport they will not be able to do this. Should I be sending some other documentation to prove my presence in the country atleast after the period I got the ILR ??

Hi Vinny

Thanks again for the above document. From what I read:

"Passports will not necessarily be stamped to show embarkation
from the United Kingdom. In these and other circumstances (e.g.
involving lost or stolen passports), applicants should be given the
benefit of any doubt where claimed absences cannot be otherwise
verified but are within the limits we would normally allow
and there are
no grounds to doubt the accuracy of the claim."

Does that mean I need not prove that I've been in the country continuously after receiving the ILR (In my case last November) The onus is on UKBA to prove me otherwise ? Also I have taken a 5 week vacation this year and hence I'm well within the limit. I hope they have a record of my absence somewhere in their system.

Hi,

I have not yet sent for SAR as i though it would get delayed in XMAS post.... so will be sending after XMAS.


Just wanted to clarify your situation... You and your wife's passports are lost with ILR? And you DO NOT have the ILR approval letter? If this is the case... Can you please update me as to what you have selected on the SAR i.e. All documents the HO hold or particular documents? Also when you get the documents can you please advise me of what the HO sent to yourself so i no what to expect?
