Hi everyone,

I am about to apply for an ILR with my family and need some help with few questions in the SET (O) form.

Guess what ? I am stuck at the very first question.

My case is 2 Years (HSMP) + 3 Years (TIER I)


1. If you are applying as a highly skilled migrant (HSMP), are you doing under the terms of the HSMP ILR judicial review policy document ? See main guidance notes for more information about this.

Yes or No

Section 3 (Page-9)

Do I have to select the 1st option under Section A or the 1st option under Section B or it should be Employment not requiring a work permit ?

Section 9 - TIER 1 (GENERAL) MIGRANTS

Previous Earnings Assessment

I am selecting the option You are claiming points for a single, consecutive 12 month period from the 15 months immediately before the date of the application

Section 9 - A5

Source of Earning - My Employer
Country of Earning - England
Currency in which Earnings were paid - GBP
Earnings claimed (in original currency) - ? Can someone help me with this please ?
Earnings in pounds sterling - ? Is it asking for my annual income ?

I do understand English language however few questions are quite confusing.

1. Yes only if you applied for HSMP approval before 04-Apr-06. Else, no.

For 9 - A5

If your earnings were paid in GBP then:

Write: "pounds Sterling (GBP)" for "currency in which earnings were paid".
Write: "£[your earnings]" for "Earnings claimed in original currency".
Write: "1" for "exchange rate applied".
Write: "£[your earnings]" again for "Earnings in pounds Sterling".

So, if you're paid in pounds, the entry in column 4 of the table should be identical to the entry in column 6.

Have a look at the points based calculator on the UKBA website - it makes this a bit clearer. It essentially anticipates that applicants will be earning some other currency and applying an exchange rate, when that's not the case with you.
