eea family permit processing time

Hi I m German national and living and working since 9 years in Uk.I been divorced recently and married last month again in India.my wife submit a eea Fp application on 29/10/12.it shows that my application is in under process.can anyone tell me please how long I have to wait.

My wife family permit is refused on 20th November.reason marriage of convience, done the appeal already from Uk with the help of solicitor.I know appeal is very long process.is it possible to apply a new application with more proofs.

You can appeal and reapply.

What was the reason given by them for concluding your marriage was one of convenience? Were you given any opportunity to provide supplementary evidence?

Reason for refusal

The decision
According to the divorce certificate that u have submitted,your husband divorced his first wife on 12/1/2012.you have submitted a marriage certificate showing your date of marriage as 25/10/2012 and then u applied as a Eea family member on 29/10/2012.additionally,there are discrepancies between ur application and what ur husband told me when I interviewed him today over the phone.on your application shows that your relationship began on 31/12/2011.your husband stated that you met on 23/10/2011.your marriage certificate states that you got married on 25/10/2012,whereas your sponser told me you got married on 25/12/2011.you have also failed to demonstrate that there is any substance to the marriage and this gives rise to suspicions that your marriage is one of convenience to facilitate your entry to the Uk.I am therefore not satisfied that u meet the requirements of regulation 2(1) of the immigration European

economic area regulations2006.

On the evidence you have presented and considering your application as a whole,I am not satisfied that u meet the requirements as the spouse or partner of an EEA National as defined by the immigration (European economic area) regulations 2006.

I therefore refused ur application because I m not satisfied that u meet all of the requirements of regulation 12 of the immigration(EEA)regulations2006.

You r entitled to appeal against the decision under regulation 29 of the immigration(EEA)amendmend regulation 2003.

As I m working on Heathrow airport on construction site very close to the runway.the lady from the BHC Delhi called me at 8 o clock in the morning.at that time I was at work.I took the call and she told me that she from embassy and want to ask me few questioned.it was too loud where I was working I told her give me 2 min that I can go the place where I can here her better.I went to the place where it was bit quiet.she ask me first when did I met first my wife.I told her that I went to my cousins marrige in India on 23th december and I saw her first time over there.but we didn't speak to eachother.later I got her phone number from my cousin and we first spoken to eachother on 31/12/2011.then she asked me when u married ur wife.It was so noisy I couldnt hear her properly.I was confused I told her first 25th December and then I said 25th October.our conversation last only about 3 min. I m so upset that they refused my wifes wife because of missunderstanding with the dates.

In my opinion your refusal is not only about only misunderstandings in dates, but about dates shortages , from the time you got married till the time she already applied was only 4 days and your recent divorce and that you didn't prove your marriage to be of substance.I am not sure if they gave you enough reasons for refusal because from what i know they should give you all the reasons in detail but they only mention that there was no evidence of substantial marriage, so in other words they didn't give your wife and you opportunity to prove otherwise. If i was to appeal i would definitively mention that and the fact which she admit that it was over the phone questioning, just maybe mention something like, working hours , loud environment, 3 minutes lasting call, Get this time things right in your appeal together with your wife mand provide evidence to show that there is substance to this marriage.

You can mention something like; the lady called for 3 minutes lasting call only in inconvenient for me working hours as i am working in construction site in loud environment.

then say; i was never given opportunity to prove,that my marriage is of substance instead in my refusal's letter it was only mentioned that evidence wasn't given

then i guess you can write about you what happened when happened what evidence you have to prove it

Now that the UKBA have come to the conclusion that your marriage is not genuine, their expectation is that you demonstrate that it is genuine.

I have lots of proof to prove that my marriage is genuine.I went three times to India this year to meet her and went togeather to our religious places.on valentines day I send her a flowers I got email confirmation that I booked flowers for her.regular phone calls history record,I engaged her on 5th January I got pictures of that.I gave her my Indian bankcard so whenever she needs a money she can withdraw from it and she withdraw money from his hometown I got all the statements. my solicitor mentioned all these things in appeal process.but I heard from people appeal process is very long.I am so upset and scared.I don't wanna loose my wife again.please help me is there any other way I can get through quickly.

You can reapply. If you choose to do this, make sure that you include plently of evidence that your marriage is genuine.

Honestly if i was in your situation i would rather not to use this kind of evidence like flowers , or cash card , cash card probably can even prove that this is marriage of convenience because she is the one to apply not you.
