Getting Married in UK (Northern Ireland)

Post by JohnDiensth » Fri Nov 16, 2012 7:07 pm

Hello,

I have been learning much from this site and am exited to be a part of it now. I will try to make this short.

I am a Canadian Citizen on a Tier 5 youth mobility Visa, currently in canada. My visa is valid until 22/09/13 and my girlfriend and I (she is an Irish citizen) are planning on getting married Jan 4th, 2013 in the north of Ireland.
We have our civil ceremony booked and will soon be giving our notice of marriage.

What do I need in order to get married in the UK? Is my currant Visa enough or do I need a marriage visa? or do I NEED a marriage Visa?

I look forward to your response,
Thank you!
Johnny

If you were already in the UK, you would be fine with your current visa. However, it's not permitted to enter the UK with the premeditated intention to marry if you don't have an entry clearance that permits marriage. So, you have a choice. Enter the UK on your Tier 5 and try to keep a straight face, or apply for a marriage visit visa or fiancee visa. The marriage visit visa might be a problem if you can't show you will leave after the marriage. Given that you will have automatic residence rights as soon as you marry an Irish citizen, it might be difficult to prove your impending departure (as you will not be obliged to go). Good luck.

There are no restrictions on marrying in the UK with a tier 5 visa nor with using such a visa to enter the UK with the intention of marrying.

I believe that if the OP were to mention this on arrival, or the admitting officer became aware of this, 321A would be something that might be considered and the officer may or may not choose to exercise his discretion. The OP is not currently inside the UK availing himself of his T5 (he has not mentioned if he has ever done so) and appears to be using it now solely for the purpose of entering the UK, marriage, and then switching his status to EU rules.

I concede that the risk is perhaps negligible if no mention of the marriage is made or detected.

I did not interpret the OPs post in the same way. However nevertheless there is nothing in the requirements for tier 5 that state he must not intend to marry in the UK so i would disagree that he would be refused entry if he mentioned he was planning to get married to the border officer.
