what if the UK breaks and Scotland goes independent

Hello everyone ,

I have a concern which I would like to expose it over here for experience charing with whoever might be going the same routes as myslef.

Well Im an ILR holder ,and I reside in Scotland where I got married with my scottish wife in first place over 2years ago.But our marriage unfortunately is going through difficult times as my wife wants to end our relationship and file for divorce as this is what she is wanting right now.to get back her independence as this is her second marriage and my first marriage.to cut it short.my question is : if she managed to get the divorce through,under the current UK immigration rules,my ILR wont get afftected purely of a divorce,and that I will have to wait another 3years after been granted ILR to be able and eligible to apply for my British Citizenship.I will not be able to apply for citizenship until the end of 2015.so what happens to my immigration category if Scotland got her independence and the UK breaks.By then Scotland will become a foreign country to the rest of the UK.so I am wondering what will be the sort of my category.

Can anyone answer my question please.if my question is still not understood well enough,just whoever might answer this dont hesitate to ask me for further explanation.

I wouldn't worry about that. Even IF the Scottish decide next year to leave the union (and that is a very big if), it will take years to put theory in practice. What about the NATO, military, nuclear subs? What about the financial streams (subsidies and such)? How to set up an independent economy? What about the currency (would Scotland become fully independent or join the EFTA or join the EU - the latter would mean taking up the troubled Euro)? What about the English/Scotish border controls (Schengen Agreement)? What about the Union Jack, would the blue vanish or would the English keep it? How to share the national dept on the one hand and the oil reserves on the other? So many questions, even if they are nuts enough to go ahead and break up the union it will take many years to sort out the mess.

Interesting question: the only way to pull that off would be to revoke the Acts of Union 1707. That would mean restoring the pre-union situation - the United Kingdom would split again into the Kingdom of England with Wales and the Kingdom of Scotland. Do the Scots still have a royal line? Just wondering about the possibilities...... *g*

I totally agree with you,I am fully aware of this political issue ,and it sounds most likely that Scotland would keep being part of the UK.but just wanted to know what happens to ILR since it has been processed and decided down in London ( England).

That is a very interesting (and unsolved) question in its own rights. If the union would break, Scotland would require its very own immigration law and Home Office. Nobody can say yet if and to which degree it will be compatible with current British law. It has not been written yet – and until it has, it will be impossible to predict how they will deal with such scenarios. If there will be a transition period, if they mutually (or single-sidedly) recognise residence criteria, leave to remain, visas, citizenship, and so on and so forth. By the time all that is sorted, you should easily have settled.
