Hi everyone,
What a wonderful site. All the kind words, info and support is amazing.
I really hope someone can give me some advice.

My husband is on an ancestral visa and is eligible for ILR in January 2013.
I am on Tier 1 general/prev HSMP expiring in Feb but will not qualify for ILR because of absence from UK.

We had always just presumed that when hubbie applies for ILR, I could apply as his dependent. I have now been told that that is not the case and that i needed to apply for a spousal/dependent visa first, before he gets ILR and only then can apply with him for ILR as his dependent.
And I am told that I can only do this from my home country, South Africa.

Is this what you know to be true? For us this means that he first has to get an extension on his ancestral, then i will go home and get a spousal visa and then we will apply for ILR together.
Is there no way I can apply for this visa from the UK while I am still here on my current Tier 1?

That is the only way if you wish to apply for settlement as a dependant of migrant in the UK based on UK ancestry (196D(v)).
