Advise Needed

My Visa clearly states I cant work more than 20 hrs during term time. My hours has been fluctuating since I got my part time job, sometimes I work 12hrs a week, then 18hrs but I have worked 24 hrs a week like twice now. Initially I wasn't concerned until i met a prophet of doom that explained in clear times the UKBA would wait for me till I want to apply for a Tier 2 visa and refuse me under a breach of conditions of present leave. ever since then I have not been able to sleep.

He said they will monitor my hours using my National Insurance number and Bank statements and duly refuse me when the time comes to switch to a Tier 2. it's difficult enough switching to a Tier 2, imagine one now getting the chance and then being refused because of working more hours.

Please what is your advise on this? Are my chances of getting a work permit now doomed because i worked more than 20hrs during term time. Please kindly explain if you have heard of cases of Tier 2 refused because of working more hours.

P.S I went to download the Tier 2 application form and the N.I number was asked for in the form.

Its obvious that you breach one of your visa conditions.

If UKBA check this out at the time of Tier-2 application in process, your visa will definately be refused.

Thanks. I just started this September and my visa doesnt expire until Feb 2014. If from Jan 2013 i work only 20hrs term time till the end of my program till when i intend to apply for a tier 2 will it still affect me?

will the ukba check all the months since when i began school? This is sounding ridiculous to me. You mean I will be denied the visa just cos i work some weeks more than 20.

Please have you heard of any real life cases of this happening?

The UKBA will definately check. The reason they put a cap on hours is so work is available to others. Even if you have only done this on a couple of occasions they might still see this as a breach of the immigration rules. Good luck in your application form. It is up to the descretion of the immigration officer to be honest.

what is your contracted hours ?
