Can a Tier-1 (General) candidate take up an offshore job assignment without affecting the ILR requirement ? The potential job offered by a company based and head-quartered in the UK. The salary would be paid in the UK, like other employee in the UK.

The duty cycle is 28-days at their offices abroad (offshore) and returning on next 28 stay cycle in the UK to maintain home base and family in the UK. By maintaining home, the council tax will be paid. Thus, there will be an alternating cycle of 28 days outside the UK and 28 days inside the UK.

Please advise, whether it would affect the ILR requirement from the required stay period perspective.

I am in a very similar situation, about to sign a contract for a role that will mean a lot of business travel that WILL take me over the 180 day rule.

Does anybody know if business travel is/isnt part of the overall 180 days limit for ILR purposes?

Share your thoughts please :D

It's not relevant that the money is paid in the UK, taxed in the UK, etc. What matters is that if you stay outside the UK for the periods you are describing (50% of your time), you will break your residence for the purposes of applying for ILR. You can continue to extend your leave for as long as you wish, but you will not be eligible for ILR until you made five unbroken years

On this very forum, I have read in the past if there is business travel with some HR/company proof (letter specifically mentioning your history etc).

It can be considered as stay. I would advise you search this forum extensively for 'business purpose stay out of country' when your actual branch is UK only.

E.g. a UK employee going to South Africa for 6-month project does/should stand a good chance for ILR.

only advice 'search this forum'.. I DID read such 'business visit' questions in past as well where someone suggested some HR/company letter idea..

P.S. - One stands 'good' chance for genuine and obvious needs. For cooking up things, well... one should/shall NOT.

Under the new rules coming into force in December you would be very close to qualifying with this arrangement, as you will be allowed 180 days absence each year. Assuming you have annual leave and those days are spent inside the UK you should be able to come under the limit.
