Tier 2 ICT - Dependent work

Post by blesson74 » Tue Nov 20, 2012 11:42 am

Hi,

I am currently in the UK on Tier 2 ICT and have leave to remain until 1st September 2013.

But my assignment (project) is now getting over on the 4th of Jan 2013.

My wife is working as my dependent. Can she continue working till the 1st of September 2013?

Thanks,
BM.

Yes, but only if "you" continue to be in the UK legally until that date.

Thanks for the quick reply.

So my current assignment is going to get over by the 4th of January 2013 but I have been granted Visa till the 1st of September 2013 as at that time my CoS had end date as 18th August 2013.

Will I be able to stay till the 1st of September 2013 even when my assignment has prematurely ended?

when the employer reports to UKBA that you finished working for them your leave will be curtailed to 60 days from the date UKBA make their decision to curtail (Note: not from the date of termination).

If your T2 ICT visa was issued before 6 Aprill 2011 you are eligible to switch to Tier 2 General provided you find a new sponsor.

Thanks manci.

I was on work permit visa from 6th Jan 2009 and which was changed to Tier 2 ICT long term establish staff when I had to extend my visa. So yes, I have been issued T2 ICT before 6th April 2011.

Will I be able to switch to T2 General after my employer reports to UKBA that I am finished but before the 60 days leave curtailment period? Or should the switch be done before my employer reports to UKBA?

start the process asap as it takes time. You don't have to wait for anything.

1. find a sponsor, preferably one that is licensed AND has a CoS allocation available
2. get the new sponsor to assign a CoS to you
3. apply for leave to remain

My 2 cents:

Beware of crook sponsors though, who try to take advantage and ask for 25-30% or even more from your take home salary every month.
