ILR - Days allowed outside UK and Minimum salary

Hi

I arrived in UK in June 2012 having a Spouse Visa of a Settled Person valid until August 2014.

1) How many days in total I am allowed outside the UK in 2 years to apply for the ILR? How about per travel?

2) How much is the minimum UK salary? Do I need to submit the last 12 months of my pay slips to apply for ILR?

1) You are expected to have not spend more than 90 days in any 12 months, have a look at the (http://www.ukba.homeoffice.gov.uk/visas ... ettlement/)

I would suggest you spend as little time out of UK i.e. visiting your home country other than holidays with your partner as possible, to avoid issues on getting your ILR. However 90 days per year is considered to be the maximum.

2) The rules for Settlement will be changing for you to show minimum salary of £18,600 next year, so before you aplpy for ILR. If you or your partner is in a permanent employment for the last 6 months before you apply for ILR. You basically need to show 6 months of payslips, bank statements, P60, employment contract, letter from the employer etc.

If you are self employed you will need to show 12 moths of documentations as above including further evidence of self employment.

PS - you can combine earninge between each other to meet the salary requirements as well.

This isn't totally correct. The 90 rule applies only to an application for British Citizenship. For ILR a reasonable amount of time spent outside of the UK during the probationary period is acceptable, with no specific limit.
As your spouse visa was issued before the 9th July changes, your route to ILR is under the old rules. In which case the £18.600 minimum earnings doesn't apply, and you will qualify for ILR in 2014.

I was under the wrong assumptions I guess as well.

So the only changes going to effecting your ILR application is the requirement to have A1 in English Language, which will be enforced from Oct 2013.

My wife did IELTS which has a validity of 2 years, but the qualification will expire before she spplies for ILR in 2014. So she will be doing it again.

Please follow Casa's advice on the questions you raised.

The language requirement from Oct 2013 for ILR will be at the higher level of B1 as well as the KOL test.

No mention of the 90 days rule in Settlement, it was me misreading it. Casa has already corrected me on this.

The webpage URL only mentions this about 'applications for British citizenship'.

Aplogies for confusing things, it seems I am out of touch today. I shall keep quiet...

Thank you harv, casa and sushdmehta for the information. I have been looking for a job since June 2012 but no luck.

1) Worst-case scenario – If I will not find work after two years, can I apply for ILR?
2) Possible-case scenario – I may be working outside UK, what is the reasonable amount outside UK during the probationary period for applying ILR?
