Partners with Tier 1 and 2 ICT, what type of visa for child?

Post by illuminatus » Thu Nov 22, 2012 12:25 pm

Dear All,

I have a Tier 1 (General) Visa that I have just extended for 3 more years. My unmarried partner received her Tier 2 ICT on November 1, 2012 and "joined" me here in the UK. We have a son, aged 4, who has been staying back in the home country (they have been visiting me on visitors visas and I have been spending 1-2 weeks each month back in the home country).

Now the time has come to bring our son to the UK as well, and I have planned to "apply him" for a Tier 1 Dependent Visa. However, based on 319H of Immigration Rules http://www.ukba.homeoffice.gov.uk/polic ... 1migrants/, not only he cannot apply for Tier 1 Dependent Visa, but he cannot apply for Tier 2 ICT Dependent Visa either, which does not make any sense.

Anyone has has similar experience? There must be a way of bringing our son over with both of us staying here on valid visas...

Thanks for any advice.
