Tier 2 ICT ILR -Any Legal Right if employer curtails leave?

Post by sphinx5 » Thu Nov 22, 2012 3:10 pm

Hi

I am on tier 2 ICT and my ILR is due in few months time.

I have read on some sites that an employer can purposely curtail Leave before this employee on ICT Visa could file ILR, as the employer in many cases feels that his employee may leave the job after ILR- for better salaries etc.

In this case , Is there any uk law that protects employees in such a scenario where they are nearing their ILR in few months & can be safely assured that the employer doesnt take advantage and curtail his/ her leave .

Is your employer considering any kind of 'curtailment'? Have you been communicated this by your employer?

Doesn't your current visa run out in 2014?

Hi , Yes my visa is valid until 2014. My employer haset done that & i dont think it will do that , but on the safer side - Im trying to know what Im supposed to do if something similar happens in course of time & if there is any such law that could protect employment in that case.

Sort out the employer letter before your employer changes his/its mind. But that letter should be dated no far out than 30 days from your PEO/postal date.

Thanks for the input . Does that mean there is no such law in Uk which would in effect protect the employee in such a scenario?
