An appeal on human right

Post by Paola » Thu Nov 22, 2012 10:41 pm

Hi All,

If one wins an appeal on human right, what kind of visa will be issued and how long will it last?

Thanks
Paola

You will probably be issued with DLR and it is unlikely the visa will be longer than 3 years.

Discretionary leave will no longer be granted in article 8 cases. If allowed on article 8 grounds you will most likely be granted 2.5 years leave under the new family/private life route.

Thank you. Can the 2.5 years leave under the new family/private life route be renewed? or the applicant will have to apply for another category of visa, such as student visa or work visa to stay after 2.5 years?

Imagine the applicant has been here for 8 years under another category of visa. After the 2.5 years leave under the new family / private life (human right case allowed), can he / she apply for permanent residency under 10 years legal stay in the UK?

Thanks
