Change of status from Tier 1 to Spouse Visa - date?

Post by odin39 » Thu Nov 22, 2012 10:59 pm

I am a UK citizen and recently married a person who was residing in the UK with a Tier 1 visa. She entered the UK with Tier 1 status well before 9 July 2012.
She would now like to renew the visa by switching category to a spouse visa (for a person "already living in the UK").
Assuming this is successful, the question is will the the spouse visa be governed by the pre-July rules (i.e. valid for 2 years, followed by indefinite leave to remain), or will the rules after July (valid for 30 months, then requiring another 30 months, total 5 years) be applicable?
UK BA website seems unclear on this point - do the old rules apply only to extensions *within the same category* or does any valid entry qualify?
Thanks in advance for any help.
