ILR with KOL - travelling to UK for short visit

Post by overseas1234 » Fri Nov 23, 2012 9:46 am

Hi,

I am a British Citizen residing overseas. My husband has been granted ILR with KOL and we plan to emigrate to the UK soon. We plan to make a short visit (1 week) to the UK to check out the schools for my 8 year old son before emigrating permanently.

Do you forsee any problems at UK immigration if

1) Just me and my son travel (my son does not have a british passport and has ILR stamp) to check out schools

2) Me, my husband and son travel - but only for a week. Would this cause possible issues at immigration ? Since my husband will be travelling on ILR but only for a week. This would be his first visit on ILR. Have visited UK numerous times on visit visa

The main intention is to visit the schools in January 2013 with a view to move permanently in June/July.

Thanks

There is no endorsement saying "ILR with KOL". Does he have "KOL REQ" or "ILE"?

In any event, I don't think that your husband will have problems entering the UK within the validity of his visa.

He has "KOL REQ". If it was just me and my son travelling, do you think they would have an issue as to why my husband isn't travelling along since both my husband and son have ILR

Your husband does not yet have ILR. He may apply for it immediately after he satisfies the KOL requirements.

If your husband isn't travelling with you and your son, then they may require his written consent for your son to travel with you.

Ok thanks ... just a quick follow up

If my husband does decide to travel with us, would there be any concern that we are only staying for a week and the current trip is not a permanent one ?

Thanks
