When the company should be registered?

When the company should be registered?

Hi there,

I am intending to apply in February 2013 for tier 1 Entrepreneur visa.

I am confused that-> When the company should be registered?

The rule says that:
(d) You:
(i) are applying for leave to remain,
(ii) have, or were last granted, leave as a Tier 1 (Post-Study Work) Migrant,
(iii) were, on a date no earlier than three months prior to the date of
application,

(1) registered with HM revenue and Customs as self-employed, or
(2) registered a new business in which you are a director, or
(3) registered as a director of an existing business,
My question is:

1. Should the company be registered 3 months before or within 3 months? i.e. If I apply in February 2013 then should the company be registered in November 2012 or it can be in January 2013 or February 2013 as well.

3 Months rule is confusing me. Anyone can simplify that please. Thanks in advance.

If it is supposed to be registered within 3 months before application then what about somebody who has registered it 4 months before the application? so confused :oops:

After the business is registered you then have only 3 months to apply; and no later. It can be anytime within that 3 month period.

Thank you for your enquiry of 1 June where you have requested information
about the Tier 1 (Entrepreneur) criteria.



This has been handled routinely outside of the Freedom of Information Act
(FOIA) 2000. Although you are in you right to make a request for
information under the FOIA, we have decided to handle your request
routinely in this instance.



Please see the information below.



In order to benefit from the reduced investment amount needed for those
switching from Tier 1 (Post-Study Work) to Tier 1 (Entrepreneur) leave,
applicants should already have been self-employed or a director in the
period before they apply.



So in order to qualify for this provision, an applicant holding a
Post-Study Work visa must be able to supply the evidence that they were
registered as a director, or as a self-employed worker, in the three
months before they apply to enter the Entrepreneur route. Applicants who
were registered for self-employment or as directors earlier than three
months before they apply may provide the evidence that they remained
registered in the three month period before the application.



While I cannot comment on your specific circumstances, I hope that this
has helped to explain the provision.

That seems correct - Sorry for the misleading info. I wasn't updated with that.

Does this means that if the company is registered within the last three months, ex: Registered in August 2012, One can apply until November?
