FAMILY VISITOR VISA REJECTED. DO I GO FOR APPEAL OR REAPPLY.

Post by tamilmaran » Fri Nov 23, 2012 3:45 pm

PLS ADVICE

My Mother's VISA as Family visitor was rejected for the following reasons (though she got the same VISA last year )

1) My wife was the sponsor and we have not given evidence for the relationship....? (Probably my passport copy will be meeting this requirement which has my mother's name and wife's name)

2) Since she is a widow and she is alone in Inida we are supporting her. Financial support is done though my brother in law's account mentioning expenses for my mother. Will this be sufficient for the proof we are supporting her. ( No money is debited to her account directly and she is not withdrawing )

3) Is it good to re-apply with these documents rather than appealing their decision.....

KINDLY ADVICE ME.....

THANKS IN ADVANCE...

It's not possible to comment effectively unless you can cite the exact working of the refusal. You can type this of scan the letter and post it to a site where we can read it.

The Decision

You state that you wish to visit your son and daughter law in the UK, and while I note you have
submitted copy of a passport and Residence Permit in the name Saraswathi Raman.
You have provided no evidence of your relationship to this person, or evidence your son’s status
in the UK. In order to assess your intentions in the UK , I must consider your personal circumstances
and I note that you have not submitted satisfactory evidence your personal and financial
circumstances. You state that you are financially supported by your son and daughter in Law
however you have provided no evidence of this claimed financial support.

I note you have submitted bank statements your and in late husband's names (Indian Bank
Accounts XXX2008 XXX1985 & respectively), however neither account shows any evidence of withdrawals to meet your living expenses in India.

You have provided no other evidence how your day to day expenses are met. In light of this lack of evidence of your financial circumstances and
commitments, and because you have immediate and extended family in the United Kingdom on
whom you claim to be wholly financially dependent ,I am not satisfied that you intend to leave the
UK at the end of your visit or that you are genuinely seeking entry as a visitor for a period not
exceeding 6 months(Paragraph 41(i) (ii) HC 395 as amended).

I have therefore refused your application because I am not satisfied, on the balance of probabilities,
that you meet all of the requirements of relevant Paragraph of the United of Kingdom immigration
Rules.

You can't appeal if the sponsor is not settled in the UK. It's not clear from the information you have provided to this forum that you or your wife are settled.

Just an update, since this post was viewed by many People.

1) My wife is the PR holder and we applied for family visitor for my mum.

2) Even though, I had an opputunity for Appealing, considered the money and time, I re-applied with more and more documentations.

3) My Mother got her visa and now she in UK

Thanks for those you tried to support.
