COA arrived but with no confirmation of right to work

Hi everyone,

We just received the COA for my partner (unmarried partners) and it says that "at this stage we are unable to confirm your right to work in the UK."

He has an EEA FP valid until Feb 28th, and we went through the appeal process to have it approved. I was under the impression that since our relationship has been proven durable, that he would have the automatic right to work. Has this happened to anyone before? I'm beginning to slightly worry in that he will once again be refused, however once the FP expires, he will be asked to leave.

We made the application on Nov 19th, it was received by the home office on Nov 20th, and COA arrived today. We included my proof of employment and payslips, utility bills in both our names, lease agreement with both our names on it and proof of address for him (an address correspondence) plus the entire folder we used in our appeal for th EEA FP which has proof of our relationship for the last 3 years.

We also wanted to travel for the xmas holidays and wanted to request our passports back, however the COA says that we shouldn't do so before the application has been decided. I have read the posts of many people who have asked for their passports to be returned, however I am now really worried that this will not go as smooth as I had hoped, especially after the FP refusal and appeal process.

Please if anyone can offer some advice or reassurance I would really appreciate it!!!

It seems the HO have change the way they work and now issue CoA as soon as they get the application (used to take 6 weeks).

As he has a EEA FP, the CoA should allow him to work. It seems the HO just issued him the standard unmarried application one without really checking his application. He should contact the HO and ask for a new one to be issued.

That's what I thought...just wanted to confirm before he makes contact with them on Monday to ask for a new one to be issued. Thank you Jambo!!!!

UKBA are not tax experts or experts on the workings of the DWP. The DWP probably knows little about the issuing of immigration documentation. A family permit is a perfectly legitimate authority for obtaining a national insurance number.

Hey Keffers,

My partner already obtained an NI number, we submitted that in with our EEA2 application as one of our proof of addresses for him. im just confused as I thought with an EEA FP he would have been issued a CoA confirming his right to work, however we received it today saying they cant confirm his right to work. Really confused as it says on everything ive read that unmarried partners dont automatically get that right, yet I thought with the Family Permit he has unrestricted work for the 6 months....now that UKBA have our passports, how can he prove that to a potential employer? Also, we want to travel at Christmas before his FP expires in February, can we request our passports back without it delaying the application process?

So I rang up this morning, spoke to a very lovely man, however he told me there was nothing he could do, and that I should write to the Liverpool office with my concern?!?!?!

Any comments, suggestions, ideas?!?!?! Drafting up a letter to next day service tomorrow, just wondering if that's what I should do in order to get a new CoA confirming my partners right to work?

Hi Soniac,

I'm interested to find out what it said on the COA in regards to requesting the passport back? Mine simply states: "We advise you not to make any non-urgent travel plans until we have decided your application and returned your passport(s) or travel document(s)".

With regard to the COA not confirming the right to work, I'd send them a copy of the COA, along with a copy of the FP, and a letter asking why the COA doesn't include confirmation of the right to work. I'd add the Case Number to the letter (even though it's on the COA) - just make it as clear and concise as possible.

Hi Soniac,

Hi Flipper77,

In regards to the passport request, it said the same thing on ours. We did send an email this morning to the Liverpool email address requesting them back and got an automated response that we will receive them within 10 working days.

Will include all that in my letter to them...thanks for that:)) And will keep you posted when we receive our passports.

Please keep us updated on changes- including the timeframe within which you receive your passport.

I'm afraid I have the same story- I received my CoA today disallowing me to work, which is simply wrong; I'm married to a Dutchie exercising treaty rights as a researcher here. I called some lawyers today, and was told to challenge the CoA, but not to hold out hope for a reversal. So I will be doing the same as you- requesting my passport back, and going home for the holidays.

Some questions:
Do you have a draft of your letter in response to the CoA you could share?
Did you include additional 'evidence' in your letter?
Have you received your passports back by now?
What number did you call for UKBA that was actually picked up?

Hi ya, we requested our passports on the liverpool address on Nov 26th and they were sent to us on Nov 29th.

In my letter I basically stated all the information of our relationship and how home office has already deemed our relationship durable....however I have not received any response to it....it was sent priority mail.

The heading on my CoA left email and ph# for getting in contact blank.
So, could you tell us what email you used to request your passports back?
I sent an email to: RODRequests@ukba.gsi.gov.uk.
The automated response I received, however, did not say they would send them within 10 days, as you say yours did? I'm wondering if there is a more specific departmental email for the european visa section.

Also, what number did you call when you got through to the 'lovely man'? So far, I've only gotten automated response systems with endless menus...

Appreciate if you can share these contact details with us! We are also hoping to get home for the holidays!

We sent our request for passprts to this address: LiverpoolEuro.PassportReturns@UKBA.gsi.gov.uk

Dont bother ringing them as they will just tell you to send an email...he was kind on the phone but gave me no help at all...good luck with getting your passports back:)

I send the request for returning my passport on 23rd of Nov, till today, I havent received my passport. I start to worry about it, it may be lost.
