Query on Tier 2 ICT under rules 6th April 2010

Post by madiraju » Sat Nov 24, 2012 8:40 pm

Hi,

I have applied for Tier 2 ICT in last week of March 2010 in India before 6th April 2010 rules came in place and my VISA was stamped on 6th April 2010. I came to UK in first week of July 2010 and I am still working with the same employer.

I have the following doubts:
1. If I continue working with the same employer and complete my 5 years in UK, am I eligible for ILR?

OR

2. If I switch to Tier 2G and complete the 5 yr tenure will my existing stay will count for ILR or will it reset the clock?

Thanks in advance!

Regards,
Ramya

I have the following doubts:
1. If I continue working with the same employer and complete my 5 years in UK, am I eligible for ILR? yes, provided the date of your application was before 6 April 2010:

"The date of your application is the date when your application fee is paid to us. This will be the date shown on your payment receipt, which depends on how you paid for your visa application - for example, at a visa application centre or online."

OR

2. If I switch to Tier 2G and complete the 5 yr tenure will my existing stay will count for ILR or will it reset the clock? it will not reset the clock provided the date of your initial T2 ICT application was before 6 April 2010 (see above)
Thanks in advance!

Hi,

Adding to my initial query dated on 24th Nov 2012:

My VISA which was applied during last week of March 2010 in India was extended 4 times within UK during 2010, 2011, 2012 under LTR(Leave to Remain).

Will the extensions made within UK effect my eligibility to ILR?

Thanks in advance!

Ramya
