Work Permit holder - ILR queries

Post by snow_uk » Sun Nov 25, 2012 9:54 pm

Folks,

I am a new member in this forum –having said that, I have spent the last few months gathering information from existing topics to avoid duplication; however I have some questions which is specific to my case and hoped some of you may be able to contribute to addressing or providing guidance.

I was granted my work permit on 18th Jan 2008 and first entered the UK in this category on 22nd Jan 2008- My current leave expires on the 18 Jan 2013 and I have been employed by the same employer since the grant of WP.
I have a PEO appointment booked for the 21st Dec at Glasgow for my wife & I (I haven’t included my child born in the UK in the ILR application)

Now, here the questions I wanted some guidance on,

1) Salary stated on my WP is £27K per annum- my earnings for the last 4 tax years are as following,
2008-09 = £35,700
2009-10 =£41,100
2010-11 =£31,900
2011-12 =£33,300
My company submitted 2 x technical changes at separate times to indicate some change in the organizational structure during 2011 and 2012 and at that time they also informed UKBA of my change in salary to at £31k and £35K respectively which was acknowledged by UKBA.
I was now wondering if the circa £36K and £41K earned during 08/09 and 9/10 would need any justification to the case worker. I recall that the increased earnings were due to doing over time but do I need a backup letter to justify them? And if so I wonder how this should be presented in writing?

2) Set O application form has in sec 1.12 for BRP reference number – I believe this is Biometric residence permit and if I don’t currently have one, do I just leave this blank?

3) My number of days away from the country accounts to a total of 141 days –on one occasion I was away from the country from 5th Dec 2010 to 16 Feb 2011, a total of 73 days. I was paid my usual salary when I was away from the country but again do I need to justify this in any form to the CW i.e. Should I take a backup letter from the employer stating I was on annual leave, still employed, etc.? (I also had the flexibility to work from my off shore office for a few days and my boss would be happy to provide me a letter if this would be required.)

4) Finally, being a work permit holder, I found that the Set (O) form was fairly light touch in terms of details required from the main applicant. I was rather surprised that there wasn’t even a section to mention my current pay, details of employer or detailed information about the defendant applying for ILR.
Pages 17 to 35 are specifically for Tier 1 migrants and I hope I’m not missing anything anywhere that I have failed to include?!
I am just conscious that my application feels light weight and wanted to double check this.

I hope the above queries are clear and are not obviously duplicated elsewhere.

Much appreciated.

1.if you started working in Jan08, your 0809 salary cannot be what you say it is. Is this from your P60? If you have, it would make sense to list those gross figures here from P60, or be precise on your salary on fiscal year basis.

2. Blank is ok

3. No harm in obtaining that employer letter, though not a requirement (as the rules are today)

4. Your understanding is correct.
Please do not send me PM if I haven't sent you one yet.
