ILR Eligibility for Dependent

Hi All,

I am trying to apply for my ILR (under Tier 1) and need just some help to understand the eligibility criteria of my wife (dependent)

Just a short summary of my situation -

1. I am currently under Tier 1 visa valid until October 2013 and my wife is a dependent and has visa validity till the same day.

2. I have completed my 5 years in the UK in August 2012. However I have been waiting for my wife to complete 2 years in the UK before she is eligible.

3. My wife entered the UK on 28th December 2010 - so she should become eligible in 2 years time from that day.

4. I have got an appointment for 7th December to apply for my ILR (Set(O)).

The UKBA website mentions that we can apply for visa 28 days before eligibility, so can I apply for my wife's ILR status on 7th December?

Any help in this matter would be appreciated.

Not sure we have almost same case but I think u can apply 28 days before only if ur current visa is ending.
Please update the thread if you get more information.
