ILR when to apply

ILR when to apply

Hello Guru's

I have filed for my wife's dependant visa back in India (Tier 1 Dependant) and am still awaiting for her approval. I am also eligible for my ILR. I have couple of queries could some one please help me understand the best option.

1] Can I file for my ILR wherein her Tier 1 Dependant is still under process or should I wait untill her dependant visa gets applied and she joins me here in UK.
2] If I file for my ILR after she arrives in UK, what would be her visa status? Does that mean in my ILR I will also have to (is it mandatory?) to file for my ILR dependant or can she still have Tier 1 dependant visa status untill my ILR gets approved and I can then file her ILR dependant at a later stage once I generate sufficient proof of co-habitation etc.
3] My out of UK days is around 261 days with no visit greater than 90 days at a stretch. my 44 days were because of company work visit, and another 88 days for my parents health. I have a letter to back that up, should I then wait untill the dec 13 rules (which gets relaxed) or should I take a head start and start applying?

Please suggest. Much appreciated.
