Quey on Tier 2 Established Staff

Hi Friends ,

I have a tier 2 ICT - Established staff visa valid from 1-Aug-2010 till 1-Aug-2013 , I have been staying in UK till date and will continue till Dec 31 this year . I have a valid offer from different sponsor . I am trying for a switch from Tier 2 ICT to tier 2 General

I have been following all the threads but not able to come to an definite answer on the following

1) As i will move back to India ( i am an Indian citizen) on DEC 31 , will the cooling period of 12 months affect me if i apply from India. I cannot apply from UK since my pjt ends here by dec.

If yes kindly let me know if someone has done so / some suitable links that i can forward to my sponsor

You cannot apply for entry clearance as a Tier 2 (General) migrant for one year from the date of your exit.

One more question before i drop the plan

In case i initiate the switch within the UK , what will be the challenges i might face to get it done before say 31rst of DEC . I have to serve 2 months of notice period in my present company also my company should NOT know of the switch before resigning as the new sponsor is a competitor company
