Tier 2 dependent UK visa for child born in uk

Post by sparya83 » Thu Nov 29, 2012 3:08 pm

Hi
I am currently working in UK on Tier 2 ICT visa for some company and I want to switch my VISA to tier 2 general within UK. I have another sponsor ready to sponsor the visa for me.
Now recently we are blessed with baby boy and he does not hold any visa as of now. Ideally he would be there on tier 2 dependent which we are planning to apply.

My query is that I switch my visa from tier 2 ICT to tier 2 general then can I
directly apply for tier 2 dependent visa for my son?
or
I need to apply for tier 2 ICT dependent for him and them switch the category to tier 2 dependent.

Your help would really be apprecaited!

Assuming the child was born in the UK and is in the UK:

A UK-born child does not require leave to stay in the UK. Such child requires leave only to enter UK (after having travelled abroad).

So you may defer your child's dependant application until (any of the following):
1. Your leave with a new sponsor has been approved.
2. The child intends to travel abroad in the near future.
3. The child travels abroad and applies for entry clearance as PBS dependant before returning to UK.

You may even choose to not apply for any leave for your UK-born child at all if the child doesn't intend to travel abroad before either parent is granted settlement.

Assuming child was born abroad and is abroad:

Apply for entry clearance after your application for leave to remain under a new sponsor has been approved.

Hi Sush
Thanks for your reply! Child is born in uk only.

Please bear with my weird questions...

I have bit confusion about below line
A UK-born child does not require leave to stay in the UK. Such child requires leave only to enter UK (after having travelled abroad).
Does it mean that If we have to travel to our country then he wont require any visa at all (Case 1: Assuming we are not coming back to uk)?
Does anyone on the UK airport will not check his VISA while we are travelling?

&
Case 2: If we need to come back to UK then he will need leave to enter as PBS dependent. Is this correct?
