Hi

I am on a Tier 2 Visa currently which is to expire in 2015. Am in my first year of my Tier 2 and so is my wife too. We both applied at the same tiem from abroad and came together to the UK. We have also been blessed with a child here now. I was offered a contract for 9 months when I came to this country but was given a 3 year visa (Tier 2) as they had plans to extend my contract but cannot do so now. Now since my contract is ending, I am switching over to another employer who will be sponsoring my Tier 2 visa for 12 months.

I want to ask is that I will definitely have to apply for my new Tier 2 visa since I won't be able to work without it (am currently awaiting my Certificate of Sponsorship from my new employer) but does my wife also need to change her visa? Her visa is also till 2015 and I am thinking that changing her visa and applying for my new born child's visa at the same time as mines will cost me a lot. So can I apply only for my visa? Will this be a problem lets say after 5 years that if I intend to apply for ILR, do they need the dependants to be on the same visa all these years?

A PBS dependant's leave is tied to that of the PBS migrant (you) and if you are making a new application for a grant of leave, because you are changing sponsors, the dependant must also apply to change his/her leave.

If the dependant is applying at the same time as the main applicant there is a reduced fee (currently £281 instead of £561).

Your wife should definitely apply for a new leave to remain.

If your new born child already has a passport you should also apply on his/her behalf if you intend to travel together in/out of he UK. See also this post:
