employer licences revoked

Post by pomi » Sat Dec 01, 2012 11:41 am

Hello
I am wandering if anyone can help me. i am on Tier 2 Skilled worker Visa since April 2010, and its about to renew in March 2013, but due to any reason my employer Licences for having foreign worker is revoked, my employer was not paying me exact wage which he did mention at the time of getting visa and i am being paying tax which was due on my stated wage. Further on asking several times my employer have never given me my tax code n any wage slip or P60 so i can find out how much tax been paid to HMRC till so far on my employment. Now i am working somewhere else and agreed with him that i will pay tax for the period. I've contacted him to pay him the required tax but now he saying me that his licences is being revoked, i am not sure that whether he is telling me true or not. Can anyone give me advice that what necessary steps should i take to save my work permit of being revoked.

If a licence is revoked the company will be removed from the register of sponsors (http://www.ukba.homeoffice.gov.uk/busin ... fsponsors/), so that would be a good way of telling if your employer is telling the truth.

you can check if your sponsor's licence has been revoked. If they don't appear in the list of sponsors it has:
http://www.ukba.homeoffice.gov.uk/sitec ... ofsponsors

If a sponsor's licence is revoked the sponsored migrants' leaves will be curtailed to 60 days unless there is less than 6 month leave remaining (which is your case).

Try and find another sponsor and a new job.

If you have been paid less than what was stated in your application then this was an abuse of the system which you can report tio UKBA, see paragraphs 249-250:
http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf

If you haven't been given payslips and P60s and if you suspect that your employer has been deducting tax from your pay that they haven't paid over to HMRC then you can report this to HMRC (and even get a reward):

If a company has their licence revoked they can't re-apply for 6 months. A new company run by the same person may be noticed by UKBA - so any such application might get refused.
