BC successful and further question

Post by rimonlhq » Mon Dec 03, 2012 10:42 am

Timeline for my BC application:
Eligibility criteria: 10yr + 1yr ILR
Method of application: NCS (Sheffield)
Date of application: 17-Oct-2012
Date of receipt by UKBA: Unknown
Date of debit of fees: 30-Oct-2012
Date of receipt of acknowledgement: 3-Nov-2012 Dated 30-Oct-2012
Date of receipt of approval: Dated 26-Nov-2012 received on 30-Nov-2012
Date of Ceremony:30th-Jan-2013

This board has been really useful throughout my immigration journey.

I have a question about the date of Ceremony that may affect my wife’s BC application.

Background for my wife’s application:
She is applying ILR using her own 10 years route. She has the bio taken at 19th Oct so expecting the ILR back in Jan next year (hopeful). Then she will apply BC immediately as she married to a British citizen and lived in UK during last 5 years.

Now the question is my planned ceremony will be 30 Jan that may become after she receive her ILR. If she receive her ILR before my ceremony would that still ok for her to apply BC immediately as she married to a British citizen? Or should I attend a private ceremony to make sure I getting my BC certificate before her ILR?

Thank you all very much.

You only become a BC following the ceremony. Not before.

Either she waits a few weeks after ILR until you attend the ceremony or you take a private one before her ILR is received.

BTW - The residential period for spouse of BC is 3 years not 5.

Thanks Jambo

Sure she will wait until my ceremony. I just want to make sure that would be ok if I become BC after the date she get ILR and no need to wait a year. I can't find information about that from UKBA.

It would be OK.
Once you become BC, she becomes spouse of BC and if she holds ILR at that point, she can apply. No need to wait.
