De Facto, please help!!!

De Facto, please help!!!

Hey Guys, People seem so helpful on this site. It's great, hopefully you will be able to help me!!!

MY mexican girlfriend is moving over here at the end of the month. She would like to stay and work here for a year. We want to apply for a de facto and i have heard a lot of different things. could you clarify a few. We have been together for over two years but lived together for just over one. We have photos, emails telephone calls, etc...

1. We have a apartment contract but its not formal. Do i need to get that translated or is it even valid since its just basically a word Doc?

2. Also facebook? Our relationship is documented on it. Is this valid?

3. She spent last Christmas here. Is this a bonus?

4. She has a return flight booked for the end of Feb. The way things worked out the price was nearly the same. Should we wait until she gets here or start trying now?

5. When they want to see finances, what do they want to see, as in how much money we have, is there a minimum we need etc... ?

6 If we can't get the de facto in time can we apply for a student visa while she is here as a "tourist" or do these things need to be sorted out before she comes over.

Thanks again and im sorry about all the questions but I wanted to gather all of them together! Hopefully someone can help me!! I have checked the websites and im sure these questions aren't answered!! Thanks again.

Hi the main thing is that you have to let her come in ireland and then apply,the only thing that u can fo to prove the 3 years together,with bills,abd her activities in ireland during the two years,like a college letter,and work,never ever state she went out of country for a year,otherwise ur case will not be powerful,just prove pn documents she was here for the 2 years.thats all,nobody will check[/list]

And concerning the statement try to make as much transaction u can,and just send them,they check the balance u have and amount of transactions made during the 2 years.

Where did you live together? from what you have written my understanding is that you were not living together in Ireland. Please clarify if my assumption is wrong.
In order to qualify for De facto Relationship, your girlfriend must have been legally resident in Ireland for 2 years. Basically, you will have to jump through so many hoops.

As above, you need to have been living in Ireland with your girlfriend.

I think you might be better off exploring the student visa route so that you might be able to apply for residency under de facto after establishing your relationship is subsisting and collecting the relevant documentation.

Hopefully, I might have answered your question but de facto relationships outside Ireland are difficult to prove.

Yes Malika. You are right I lived in Mexico with her. When I heard that I must prove that we lived together I thought it was obvious that is was outside of Ireland because the whole point of her getting a de facto visa is to stay in Ireland for a year!How can she live hear without that visa? If she could live here we wouldn't need a de facto visa! I'm not sure of the point of a de facto visa then?... doesn't make sense to me.

I had looked at that page you sent me and it doesn't mention anything about living together but I heard though other sources that it is.

The other route is To get a work permit is just one big vicious circle: to get a permit you need to be sponsored to get sponsored you need to have a job, to have a job you need a work permit.... very frustrating.

This applies to someone who is already here.

All non-EEA nationals need permission to remain in the State. Permission to remain will be in the form of an endorsement in your passport confirming the conditions and period of time for which you have permission to remain in the State. With this quote from the link I provided, by needing a permission to remain in the state means that someone is here legally........anyway,that's my understanding

I am Irish.

Student visa is a route we probably have to go with as I heard that it might take up to 6 months to get a de facto visa and we only have 2 months at the moment.

Is it possible to change from a tourist visa to a student visa while she is here or does it need to be sorted out before she comes in three weeks??
