Documents for license of sponsorship(Head office and branch)

Post by ddfmsh » Mon Dec 03, 2012 11:26 pm

My new employer is going to register the license of sponsorship very soon, I am just wondering about the documents for the companies which has head office and branch offices, as being advised by the UKBA guidance:

If you are applying as a head office and all branches or a group of branches, you must
submit any legal accreditation for each individual branch within that group.

anyone knows what sort of documents can be used as the legal accreditation document?

the company is small private limited company with 2 branch offices in UK, as i will be working in one of the branch offices.

Thanks.

are you on a PSW visa?

Does the company have a Head Office as well as two (branch) offices?

Have you read paras 50-51 of the T2 sponsor guidance?

Is the UK organisation owned by an overseas entity?

What is your involvement in the company's sponsor licence application? Have you been asked for help/advice? Does the company have a professional advisor, e.g. solicitor?

Hi Manci,
Thanks for your reply.

1. Yes, I am on PSW visa.

2.I have read the paras 50-51, but there is no specific document requirement for this.

3. No, the company is not owned by overseas entity, they are UK company, has branch offices in UK.

4.i think i need to tell them what documents they need to prepare for registering the license, i don't think they will use the professional advisor service to get the license of sponsorship.[/quote]

yes. The company has a Head office in UK. When they are applying for the license of sponsorship, they should include both the Head office and each branch offices.

not absolutely necessary. If the Head Office sponsors you, employs you, pays your salary, fulfils its sponsor duties to UKBA, etc. then your place of work can be at the branch without the branch having a sponsor licence. In the CoS the "main work address in the UK" should then be given as the branch address. Also, if later on they want you to work at the other branch, they just have to inform UKBA of the change of your work address.

Hi Manci,

Many thanks for your clarification, which means the company only need to register the license of sponsorship for the head office. After they successfully registered, then I can work for any of the branch offices of this company in UK by applying for the Tier 2 work visa.

However, the below information from UKBA website is a bit confusing:

http://www.ukba.homeoffice.gov.uk/busin ... s/#header1

If your organisation has a number of different offices, branches, locations or campuses (which we call branches), you can register in a number of ways. You can:
apply for a single licence which includes your head office and any or all of your branches in the UK;
apply for a separate licence for each branch; and/or
group a number of branches in a single licence.

this is primarily an administration issue which concerns who employs you, who pays your salary and who carries out the sponsorship functions relating to you (reporting, record keeping, etc.). If they want the branch, rather than the Head Office, to carry out these functions then the branch must have a licence. This is up to the employer.
