Asylum Claim

Post by Jamiepassport » Tue Dec 04, 2012 8:49 pm

I will like to find out if an individual already married to a British citizen apply for asylum within the UK with the purpose of probably getting a discretionary leave to remain.. as he has been refused the two years spouse visa due to submitting his application late. (Family issues and circumstances)
Hence, his application has been under reconsideration for over two and a half years with the homeoffice.

Any advice will help..thanks

No, your situation does not match the requirements for asylum.

Typically, asylum is claimed by someone who arrives at the border of a country which they hope will protect them from impending threats or persecution if they were to return to their homeland.

Not necessarily. A person may become a refugee sur place or indeed may delay in claiming for a variety of genuine reasons.

Op does the person in question actually fear return to his country or does he just want to claim asylum so he can be granted discretionary leave?

.....or be accused of s e x crimes in Sweden and claim it's all a CIA conspiracy. I was speaking generally and deliberately being simplistic because I felt that the OP was perhaps confusing asylum claims with Human rights claims with regard to a family life.

On an entirely separate, why does the forum software automatically change s e x to gender when the letters are placed together?
