PR REFUSED! Please help.

Hello everyone.

My application for PR was refused because I didn't show that my EEA wife was exercising her treaty right up till the time of our divorce.

I got the document UKBA was requesting for but didn't included it in my application when I applied initially because I didn't know.

The following are the full details;

We got married in October 2006

I got my 5years RC on June 2007

She worked with a company till August 2007

She was self employed from August 2007 till December 2008

She started claiming job seeker allowance in January 2009 till we divorced

We divorced in November 2011

I applied in may 2012

Refused in November 2012

According to UKBA, "you showed your EEA p60 for 2006/2007, some payslips for 2007, self assessment for 2007/2008 and 2008/2009 but you refused to show what she was doing till your divorce date in November 2011". On this reason, your application is refused.

I got a letter from HMRC that stated that she was collecting job seeker allowance from January 2009 till the date of divorce in November which was what the UKBA said was missing.

Please what I want to know is that; since my application was refused based on the above reason alone, do I need to prepare myself for anything else or that is it.

Please my hearing is next month and I was also told to send all the documents I sent to UKBA for my application with my statement to the tribunal and UKBA and that UKBA will send me their own bundle too.

Well you certainly need to prepare yourself. She was on Jobseekers allowance for a very long period indeed. Was she made redundant from her previous job, and can you prove this?.

For any appeal you will need preparing and for this one you will need even more explaining , in regards to the length of time she was on JSA, and the cause of her unemployment. You will need to demonatrate that during this period, she had a realistic prospect of seeking work, given her qualification and experience. Wish you all the best.
