Hi all

I have a Spouse Visa from a settled person (Old Rule); I arrived in UK in June 2012 which I am eligible to apply for my ILR 28 days before my 2nd anniversary in June 2014. I have been unemployed for 6 months now and no luck in finding work to date. So to be productive, may I ask if I can work outside UK from?

a) 1 January – 23 March 2013 – less than 90 days
I will be in the UK from 24 March – 31 March 2013.

b) 1 April -28 June 2013 – less than 90 days

The 90 day rule only applies to British Citizenship qualification, not ILR. The main issue will be to prove that your relationship is maintained during your absences. By the way...you can apply for ILR 28 days before the 2nd anniversary of the date you first arrived in the UK on your spouse visa.

Mobile calls, emails...any method of contact you use to keep in contact. I'm assuming you'll continue to have joint bills/correspondence addressed to your home in the UK.
Just bear in mind that when the time comes for you to apply for BC, you can't have spent more than 90 days in total outside of the UK in the 12 months leading up to the BC application.
