Settlement visa for Dependants - WP Route

Hi,

I have got ILR (2011) and subsequently British citizenship (2012) through WP(5 years)+ ILR(1year)+ Naturalisation.


My wife and child(born in UK) currently in my home country holding WP dependant visa which is valid till Mar-2013.

Can I apply for their settlement directly with out waiting for 5 more years ?

Also are the new rules introduced after july 2012 still applicable in my situation?

Any suggestion and inputs would be very helpful.

I was under the impression that thedependants visa is no longer valid.

but after reading this

it looks they can still return with old visa and apply for settlement before their current visa expires..

Could any senior advisors please guide me ?

From the thread you highlighted above, it is clear that your wife can travel back to the UK as the current VISA they hold is still valid.

If you wife has already completed 2 years probationary period in the UK, you should be able to apply for ILR for her. Otherwise you will possibly need to get FLR and then after 5 years ILR.

Sushmehta knows this VISA category very well, hopefully she can comment further on this.
Feb 2012 - Spouse Visa - New Delhi
Mar 2012 - Documents collected - VISA Granted
March 2014 - ILR Granted
Apr 2015 - Applied for Naturalisation
Nov 2015 - Naturalised

Just one more query while applying settlement ,does my wife still need to complete 2 years ?

Does this rule not applicable for WP dependant visa holders?

I am not 100% sure about this.

I think you should read the thread you highlighted above, I am sure you will get your answer.

I have a felling that 2 years probation period may not apply to you, but I am not an expert in this.
