ILR – Earnings

Post by splashing » Thu Dec 06, 2012 2:39 pm

Honestly, the best advice comes from this forum. The more you listen to people outside, the more scary you get and nervous.

Please advise on below:
My gross salary in the last 12 months is £32,300 which i intend to disclose and use for my ILR application. With this salary, i will be able to claim 30points from the table 2 in the settlement guidance.
However, when i applied for my tier 1 General visa in 2010, the earnings i disclosed then was £34,500(increase was a result of bonus).
Now a friend is saying that my salary which am going to disclose for my ILR now must not be lower than what i disclosed in January 2010 when i was applying for Tier 1 General which am currently now on.
Is this true.?
Please advise needed urgently as i don’t want to go thru the stress of adding self employed earnings.

Ask your friend if he can refer to any guidelines or rules to support his claim.

As long as you get sufficient points, previous salary is not important. I have recently received my ILR with £33,000 earnings, and my earning in the previous Tier1 application was £34,000. I only needed £30,000 to earn the sufficient points in both the cases

No. There is nothing in the immigration rules which states that your current salary must be >= to the salary you claimed points for in your previous application. What you must do is claim the total points required to qualify - this is made up of previous earnings, age, qualifications etc...

There is nothing as such, you can happily go forward.
