ILR from Tier-1 General

Hi to all,

I am on Tier-1 General Visa & my entry date to uk was on 24th March 2009 while my visa issue date is 08th dec 2008 & as per my visa i am completing my 5 years in dec 2013 but i am not sure whether i am eligible to apply for ILR as my entry date to uk is in March 2009. could some one let me know should i apply for ILR or apply for extension & if yes what would be the validity of my extension ? & after extension can i apply for ILR in just 3 months that will make my continuous period in uk to be 5 years from the date of entry. could some one explain in detail. my visa & my wife visa is about to expire in dec 2013. aslo my baby is due in Apr 2013 should i also need to apply for his visa or can i ignore it & to take my baby to india & come back again i guess i need to apply for his visa aswell.

Please let me know in detail.

1. your 5 yr count begins from date of entry

2. you can apply anytime you complete 5 yrs; you can actually make the application during the 28 days leading to the completion of 5 yrs

3. if your child is born in UK AFTER you get ILR, then you simply apply for the child's passport. if your child is born in UK Before you get ILR, you first register your child as a British Citizen and then apply for British passport. It is not necessary to get child's native passport / UK visa if the child is born in UK. Please read through the Citizenship section of this board for more info/discussion on this issue.

That mean i need to apply for extension & apply for ILR in the next 3 months of extension so in that case do i need to pay for both application fees or one application fee would be refunded back after ILR. could some one through some light on this ?

u will have to pay for extension and ILR applications separately.this is home office , pounds factory for GB.
