Getting married in the UK to a person with Student Visa

Dear all,

I have my ILR and trying to bring my girl friend over to the UK as soon as possible. I am planning to marry her in the UK.

When I looked at the rules of spouse visa application and entry clearance it looks so complicate and I anticipate the waiting time to get an entry clearance for her could be 6-12 month. The reason being I am in Malaysia for the past 1.5 years and need to show proof of income etc in the UK which will take sometime.

As a way around this I thought I would ask my girlfriend to obtain a student visa to the UK. Can I ask her to apply for a student visa and take her to the UK then marry her and convert into married partner over there in the UK. Our Malaysian passport does not require a visa to come to the UK however I believe as a tourist she cannot switch to a married partner's visa.

In a nutshell my girl friend has been forced to marry here in Malaysia in yr2000 with someone she doesn't like and now want to follow me back to the UK to be with me. We were in love for 7 years prior to her marriage in Malaysia. Our relationship did not work out at that time since her parents did not accept me as I did not match their social status.


I would deeply appreciate from experts to give me some opinion advice. I have posted previously with little details. Now I have providing more info.

She can go to the UK as a student. She can marry you in the UK and then switch her status to settlement. This is not possible as a visitor. The financial conditions for switching into settlement are the same as those for entry clearance (visa).

She obviously can't marry you while she's still married to someone else.
